Soft closing is when the buyer and seller transfer possession and a percentage of the purchase price before the actual official title transfer. And what does this mean, you may ask. Well, it means that the selling-buying process happens in a partial way before signing the actual deed or ‘‘escrituras” officially.
There might be many reasons why we could expect a soft closing situation. But, the two most common reasons why this happens are two. The first one is that there might be a delay from the trustee bank to transfer the title, and even if the money is there and everything else is on point, the bank is not able to release the title just yet. The other situation is that the seller’s financing paperwork is still tied to the procedure of the title transfer as well. Although, no matter the reason for you to be facing a possible soft closing just make sure to use a real estate attorney to prepare that private contract between the two parts involved. Do it the right way and go across the legal procedures needed to do it properly.
One of the nice things about soft closing is that you can close the deal really fast. This means that the seller gets a part of the money on his property right away and the buyer can get their new purchased possession quickly too.
